Can Anyone Own A Legal Practise
Discussion
Let's say someone who was not a lawyer wanted to offer a specialised legal service using salery based legal staff who have no ownership. Can the company obtain the correct insurance as long as the work is carried out by a qualified professional or would you need to have a lawyer in an offical officer capasity to make it legal?

The simple answer is no.
You can try and set up an "Alternative Business Structure"

I did have a look at the ABS but was unsure if its something that would be feasible. You can try and set up an "Alternative Business Structure"

It depends if you are offering a reserved activity. If not, you don't need to be regulated and as far as I can tell you can do what you want: no insurance, no complaints process, no compensation arrangements.
What services are you planning on offering?
It is in the conveyancing bracket What services are you planning on offering?

Unfortunately that falls under the reserved activities. Your "first port of call" regulator would be the CLC and you would need to be an ABS. Their licensing framework is here http://www.conveyancer.org.uk/CLCSite/media/PDFs/L...lostmotel said:

Or find a qualified lawyer you trust and sort it out with them.uber said:

I suggest the first step would be to learn how to spell 'practice', 'salary' and 'capacity'...!uber said:

I'm sorry that me being dyslexic offends you should I go and sit in the corner and wear a dunce cap?Good luck with your proposed venture though....

In fairness to sidicks, he wasn't to know that, and obviously anything to do with legal contracts spelling needs to be spot on.

No real offence taken my spelling ability does not affect my ability to run a business although I am upset my £30 a month subscription to an advanced spell checker does not work!. Thankfully I have no intention of writing contracts which is why I'm looking to see if I can hire someone to do it. Good luck with your proposed venture though....

If you can't find a lawyer you trust you may be best looking for a firm an offer your service on an "outsourced" basis.
My main concern with that sort of deal would be the core product and the entire business would be dependent on someone else and should they go bust, break up etc leave our product/service in a bad place. uber said:

There isn't a lot you can do really. It's quite a complex area and there are ways of achieving something like what you want but you would need specialist advice about the structuring.

Completely agree about the advice from an expert. Any ideas where you find that kind of consultant It's quite a complex area and there are ways of achieving something like what you want but you would need specialist advice about the structuring.

No offence intended, but obviously anyone seeking a lawyer is likely to be put off by spelling mistakes as it doesn't demonstrate the level of attention to detail that would be desired!

Similarly, I've wondered how it works for accounting contractors - presumably they don't all have individual practicing certificates. Might be that ABS - I'll check the link.
You don't find many accounting contractors signing off accounts, which is what the certificate is needed for.Gassing Station | Business | Top of Page | What's New | My Stuff
