Company A claim Company B owe them a debt of 11k, and confirm this in writing. They then realise the debt needs to be sub 10k for small claims, so apply a made up day rate discount to fall into this category.

Can they do this?

For further information an agreement was struck between company A and B for a payment of £2k. Company A then changed what was included and a negotiation of £1.8k was offered. Court is now on the cards over £200..

No dodgy backdated accounting required, all they need to do is send an offer to settle the balance owed for a discounted price of £9999. When they are ignored they can then claim for £9999.

You say it's over £200, but also say they are willing to discount £1k from the total to get into small claims. It sound like there is more to it, otherwise why not just pay the discounted £10k?

It all got a bit messy to be honest.

An agreement was reached for £1800 shortly after posting this, company A were just trying it on as the 'debt' was never going to stand up in any sort of court.
