Money Claim Online - Business
Discussion
Never had to do this before because customers are pretty good at paying but we've been waiting for £21,000 now since February so I submitted a claim online using the MoneyClaims service on 16th July.
It looks like this gives them until 15th August to come up with a response. However, since then they have made 4x random payments of £1,000 in to our account. Slightly worried this gives them a defence along the lines of them paying it, albeit slowly. It's cost £1,082.66 to submit the claim and this has been added on to the amount as well as the 8% interest you are allowed to add on so the total is £22,841.66
Having not done this before, does anyone have any feedback on his it plays out after this point if they do or don't respond please?

Now that you have submitted the claim, you need to sit back an wait for the MCOL system to do its thing.
If they don't submit a defence by the due date, they you can try for summary judgement.
If they are making small payments in the meantime, then it might be to show the court some effort & goodwill from their side to help with their defence. The upside for you is that you are at least getting some of the money & the debt is reducing.
However, the MCOL system seems to be very slow, especially in my own experience.
My company is being sued for a small amount (£1,500), which I am disputing. The claim was submitted in 2019, and I am still waiting for my day in court, over 6 years later.

Oh wow, I can t be bothered with it carrying on that length of time.
The whole thing is a bit pointless if that happens.
Not if it's getting 8% interest...The whole thing is a bit pointless if that happens.
Calendar time is not as important as how much of your personal time it takes, and that's likely to be the same whether it takes 5 weeks or 5 years. And you have £22K to get back.
