Hello Pistonheaders,

I was wondering if you could help clear up and arguement for me please.

Here's the situation:

A friend runs a business that deals with other businesses in their sector. After working with, 'X' company he uses their logo on his website to publish the fact that he has worked in conjuction with them.

Say for arguements sake, I own a high end valenting company and I say worked on a project to clean 25 cars for Aston Martin. Would it be legally right or will I be allowed to use the aston martin logo on the valenting companies website?

Would I as the owner be allowed to automatically allowed to use there logo as I worked for them?
Would it cause any problems for company in the future?

I'd like to hear the good and the bad and everything that comes with it.

You should definately ask them first.

Ask them from the point of view that you want to put a link on your website and would like to use their logo as a button.

I would have thought that AM would have registered their trade mark and unauthorised use of it may be a problem.

In either case, I would check with them and obtain permission.

Registered and unregistered trademarks are the property of their creator. If you use it without their permission, you violate their copyright, whether they have applied for a trademark or not.

That said, a lot of companies are pretty reasonable about this sort of thing, as long as it's not confidential or sensitive work you are doing for them. It's best to ask first, but they will probably say yes, and if you offer to include a link to their own website, it will help grease the wheels a bit.

If on the other hand you simply use their name, rather than their logo, and you haven't signed up to any kind of non-disclosure agreement, you are simply stating a fact that you have worked for that company in the past, which would be pretty safe.

Bottom line - it depends on the company.

Some don't/won't care and others will not under any circumstance allow the use of their logo.

As already suggested, the only way to find out is to ask them.

But I suspect the answer will be "no" - as their website clearly states "The unauthorized use of any trademark displayed on this site is strictly prohibited."

The simple answer is 'no' as this constitutes trading off someone elses brand.

Unless, as stated above, you have their permission.
