Employee Liability in German Law
Discussion
Hello,
I'm in the process of buying the IP to some software. The company that owns this software is German and they have come back and said our standard clause on Public and Employee liability in the contract is unacceptable. The real frustration is that Employee liability is a requirement of English Law and our insurance covers us for up to £5M. During the writing of the contract we assumed there to be a similar law in Germany but now this has become a problem in the negotiation process.
I know the German company is in discussion with its insurers but I was wondering if anyone knows if there is an equivalent law in Germany to our Employee liability and what that law might be called. I'm trapsing through the EU website but thought some of you guys may have come across this before...

Some very basic information here: www.lloyds.com/Lloyds_Worldwide/Country_guides/Germany/Germany+Quick+reference+guide.htm?country=Germany. Workers Comp is the German equivalent of Employers Liability cover.
I'm out of the office today but might be able to get you more info over the weekend, if required.
