Any legal experts.....Terms and conditions on hotel booking
Discussion
Any experts out there
I booked a local hotel back in March for 2 days so i could run a seminar in their conference hall. We have various email back and forth to confirm this was going ahead. At the same time they sent me two booking forms and ask for a deposit.
A few days before the first booking i had to cancel the first day....so i gave in the booking sheet for ONLY the 2nd day and the deposit for that day.
Now - the venue is invoicing for BOTH days saying that we didnt give enough time in cancelling the first day and that our emails were confirmation of our intending to go ahead.
BUT....their booking forms (of which i ONLY signed the one for the 2nd day) states in the terms and conditions....in the very first line!...." all reservations are provisional until a written confirmation is received together with the signed and dated copy of this sheet together with the deposit"
Now i offered to pay 50% of what they are asking for but they have said "no - full payemnt for the day is due as you didnt give enough notice"......so i feel like saying "well toiough then, you dont get a penny as your T&C cleary say we never conrimed - or am i still stuck because of the emails????
any help????

Funnily enough...we have another booking with them. When i made it i said i would pay the full amount due for the cancelled event but wanted 50% of it to go towards our deposit for the new event (effectively offering them half).....but as they are sticking to what they think is right i am tempted to do likewise and stick to their OWN T&C's
This is an easy one.
Under usual circumstances, if there is an offer, consideration and acceptance then a contract is formed.
However, in their T&Cs they are stating that there is no contract formed until you have confirmed on *their* form and sent a deposit.
There is no contract formed, and thus there is nothing to cancel. Indeed, the whole reason that this is put in their terms and conditions is so they *they* can prove that there is no contract without the correct booking procedure, so they can pull out without financial consequence.
Tell them you wont pay a penny.
