Chaps,

A friend of mine who is a driver for a car hire company. He is on a contract basis, not on a permanent basis. He delivered a car to a customer's house of which is on a congestion charge zone and didn't realise that he entered the cc zone!

The company he works for has had to pay £60 fine and they want it to be charged to the driver. The driver is refusing to pay it. What is his rights?

Thanks

He should really take notice of the massive red and white C's that are emblazoned over the road when you enter the zone.

Completely normal for the employee to be charged the fines.

Does the company not have the congestion charge covered in their ts and cs with the customer?

I can't work out whether the delivery point was in or out of the zone - Surely if the delivery point was within the C-Charge zone and the driver was just asked to deliver the car there, then he could reasonably have expected that the charge had already been accounted for and payment taken care of - the office knew where he was going and there's no way to deliver within the zone without going in the zone after all. If however the destination was not "in" the zone but only close, yet he strayed within the zone whilst en route there, then yes that is the drivers fault and yes he should pay.

used the sat nav to go on the ring road thru the congestion zone, park lane and the road to the south of it, did not know it existed as tax free zone

all depends if the drop was in the zone or not, if inside then the company should have pre-paid the charge

My FiL is a delivery driver. The company pays the CC charge and parking tickets.

They advise the clients in advance that large item delivery during certain hours will cost £60, and £10 at the weekends.

Surely it depends on what his contract says, and/or on what the companies policy is.

However if the delivery address was in the congestion charge zone then surely it is up to the hirer to pay as the hire company cannot get the car there without going into the zone.

If the delivery address was not in the zone then isn't it up to the company to tell the driver that either congestion charge has been paid so he can go through the zone, or it has not therefore he is to go round it.
