Recently one of my employees decided to leave and setup a rival company, alhtough slightly peeved about it I let it go as business is business etc and I really couldnt be bothered nor have the time to take him to court etc. I now find out his company name is basically a rip off of ours and he's using our customers where he did work as refernce sites on his website.

If the work he is showcasing on his own site was created by him during his time working for you, then surely that work is the copyright of your company...?

I'd phone him up, wish him good luck but suggest it's pretty bad form that he's got your company's work showcased on his site and it's really not on. If he gets arsey, let him know that you really don't like the cut of his gib and that the showcased work is that of your company and he's attempting to pass it off as his own. Fraud, deception, plagiarism, I don't know what you call it but it's surely not on...

Was there anything in their contract stating this is not allowed?

I know the contract I just signed had a period where you cant contact current/existing customers if you leave.....

Always in contracts, but very difficult to enforce unless you can get your customers on your side, and even then you have to question whether it si really worth the trouble of going to court to prove it.

If they are ripping your stuff off, then there is a lesson there to copyright your website and make sure your contract covers intellectual property, or talk to a lawyer pronto.

In terms of the work he has done, if he did the work then he can, afaik, genuinley tell other people thats what he did, unless you can prove otherwise of course. Its no more than an on-line, visible CV.

Doesn't help, I know, but gives you a bit more background.

Agree breach of IPR and will be in contract.

It may be easier to talk to Nominet (if it s .co.uk domain name) and get their domain name revoked.

1) They are using a domain name that tries to impersonate yours.
2) They are using your IPR.

Also a solicitors letter may have an impact, but any sort of hacking could get you into serious trouble.
Misuse of Computer's act probably carries higher penalties than TWOC'ing and Death by DD.

Everyone seems to have steered clear of the issue of 'hacking' (presumably taking it was not intended literally) but I would suggest that asking for that kind of 'service' on a public BBS is not on, and should be removed/edited by Ted at the earliest opportunity.
