Bought a ps2 game on ebay. As ps2 games go it's expensive at 45 quid but it's not the end of the world

It's got a damaged case and scratched discs which I'm annoyed about as it was listed 'like new condition', I'd not have bought it otherwise. Packaging was spot on, like really well protected so it hasn't been damaged in transit.

Trying to get a refund, seller is accusing me of trying to send an item back that wasn't the one he sent. Says he is happy to accept the refund but has taken it up with ebay, so where does this leave me when I send the game back? Not sure who ebay sides with these days.

I've heard this so many times on here and other forums over the years and had people try it on with me in the past so I'm unsure what eBay are going to say. Bit annoyed but tbf this is the 2nd problem in about 15 years I've had.

Just go through the returns procedure and return as item not as described. You will probably get a return label. Take a note of the tracking number and return, you will receive a refund on receipt/delivery if you don't just escalate it. You will have no problems with a refund.

Thanks I got a label yeah, just feels like a compelling case from the seller and I know full well people try this sort of scam

The game is Metal Gear Solid 3 Subsistence. To add to a growing collection of my childhood garbage. Not a good time to be buying games some of these are rather expensive now, lockdown related price increase maybe?
