Basically, my other halfs phone provider (Let's call them 'Lemon') gave her an N97 Mini as an upgrade a while ago.

The phone has been faulty with the same fault and sent back 3 times, Lemon said to her that if it's faulty for the third time she can change phones.

Unfortunately they've offered her two particularly crap phones as a replacement - Is there anything that she can do to negotiate a better offer?

The only other alternative they said is that they'd cancel her contract for £300... tts....

Complain, why should she accept anything other than a like for like swap? Tell them its that or trading standards.

laugh My thoughts exactly!

Is the reason that they won't replace like for like because the whole batch is faulty? If that's what she's signed up to receive then that's what they should give her.

Maybe I was just obfuscating with fruit biggrin

She doesn't want the same phone, because all 3 have been awful, I think the software that Lemon rape them with as standard doesn't do it any favours either.

She basically wants a phone that she could've chosen at teh time, which I think is fair enough!

That's fair enough really. As far as I'm aware, certain phones are only available on certain levels of contract - usually dependant on how much you are paying.

If the phone that she wants is within the band for the contract that she pays for then I don't see why it would be unreasonable of you to request that phone.

Have you dealt with the store manager or just the salesmen?

I think just the salesmen, it's Lemon online rather than in store.

They've offered her an HTC Hero as a replacement to her N97 Mini, unfortunately it's a refurb.

Should it not be new? As a refurb isn't a like for like replacement for the new phone she got on her contract?

But an HTC Hero isn't a like for like replacement anyway, the only like for like is another N97

They offered her a 6700 before, which spec wise is nothing like the N97.
