A few years ago I took out a mobile broadband package from my mobile provider.
I was paying £10 per month and the contract was under a fair usage policy whereby if I exceeded the download limit I would be warned twice before I was charged anything.
I don't download much stuff so all went fine for 2 years or so then I received a bill for £300.
On checking this was as my son had downloaded a film.
I contacted the mobile provider and attempted to explain but they said the fair usage contracts had been phased out so I would have to pay.
I referred the matter to OTELO and when they got back to me they had decided in favour of the provider as there was no evidence of the existence of a fair usage policy. This despite a nationwide ad campaign offering this policy.
Any ideas?

if the provider confirmed that yoy were on a fair usage policy and this had been changed then fight it.

They cannot change the t's and c's without giving you written notice.

What provider / sales channel was it, and when did you take out the agreement?

Seems the provider assured otelo that they had not had a fair usage policy and otelo took them at their word,
Can't name them, forum rules (V)

check your old bills, one sneaky trick as carried out by one provider I know of is to bury the terms of variation on the bill somewhere..

Do you have your original contract???

Can't find the original contract but was able to provide evidence of it being sold me under a fair usage contract (leaflet advertising it) but otelo still accepted the word of the company that they had never offered a fair usage contract.

Pay the bill, then burn the porn that you, the kid downloaded onto some DVD's and flog them. You will get that £300 back in no time.
