R129 - no nearside foglight - help, confused?!!

Hi All
I had a 'bulb out' warning light on the dash, so investigated all the lights and the problem seemed to be the nearside rear fog. The light would glow at normal brightness but wouldn't light up the second filament when the fog lights were switched on.
On swapping the bulbs over, the nearside fog is still out - so the problem isn't the bulb.
On inspecting the bulb holder I see that there is no terminal for the additional filament in the bulb? Also there is no 2nd wire running to the socket so it's not as if the 2nd terminal has broken off.
Is this correct? Is there only supposed to be a foglight on the offside?
ETA: Did some more reading up online and it appears this is intentional - only the offside now required by law?
Confused because I failed an MOT a couple of years ago for only having 1 rear fog working on a 1992 BMW E30 when apparently, because it came fitted with two, I should have had both working?!
