I'm posting this on behalf of my hapless Uncle who has unfortunately been mugged by his soon to be ex-wife.

He bought a car on finance (MCS), the car went in her name on the V5. She is refusing to hand the car back to him so he can move the car on to clear the outstanding finance.

He is worried that she will do some real damage to the vehicle if she finds out he is going to 'repossess' his car without her consent.

I haven't asked ths question yet, but I thought to be eligible to be named on the V5, you had to be paying the finance, or at least be linked to it. confused

Also, can anyone suggest a good Solicitor for CSA/Access arrangements when the st hits the fan over this?

Thanks in advancesmile

Being on the V5 does not indicate ownership - it indicates the registered keeper.

If the finance agreement purely states your uncle, it could be proved that he is the owner.

I know, I think he's unsure what documents he could take or would need to get a duplicate keysmile

Your uncle needs to get some family legal advice from some one other than off a auto forum I would say.

I've suggested that. But i'm not sure the legal bods will be up on their BMW replacement keys policylaugh

I think hes worried BMW automatically inform the registered keeper if an attempt to gain keys has been made. I can say its 95% certain she'd fk the car up just to make life difficult.

Before he goes about this, I would agree, and have already suggested he gets advice to make sure he's not shooting himself in the foot in the long run with proceedings.
