Good Evening,

Bit of a dilemma guys, but stick with me... smile

About 8 weeks ago I was made redundant, however an old manager (who I worked under and had fell out with before over various things – turns out he went bankrupt) called me to say he had started another business backed by a different chap and was about a year in and they were looking to recruit someone at my level.

To cut a long story short I took the job, however since I have been there I have come to realise all is not as it first seems and the chap that is bankrolling the company has been banned from trading for 10yrs and his wife for 3 after a previous company they owned went bust with debts over 2 million, he owes a lot of people a lot of money!mad I googled his name and its all been in some of the national papers as well - which does explain why he won’t come into the office and gets us to run in and out to his car with stuff.

I have just completed my first month and been paid cash in hand, still no job offer letter, no expenses even though they have been promised a few times now. I really don’t know what to do, if I had known all this before I wouldn’t have touched it with a barge pole. The thought of going another month fills me with dread but if I don't wait around till next payday I almost can garantee I won't get paid!furious I have do have a few irons in the fire with other employers and a small business that provides some additional income at present.

But should I walk now? Or let it run another month till I can hopefully secure alternative employment?
P.S They have had a lady working for them who as it turns out has been stitched up a treat, no NI or PAYE taken for the last twelve months, masses of unpaid expenses, no P60 for tax credits and even though the director agreed to pay towards an outstanding council tax bill as agreed with the council (she hasn't had any pay slips but he has been deducting something for it) he hasn’t at all and now a county court judgement has landed on her doorstep as no attempt has been made to pay it....

Your thoughts please guys

Get your wages and leave. Don't expect them to have paid your tax or NI.

Thats what I'm thinking to be honest although the wife doesn't want me to quit without having something else but unless I hang it out til the end of the month I will have lost money as I will have been commuting etc and I'm 95% certian they won't pay.....

Get what you can in terms of wages and expenses and then leave straight away. The longer you stay, the bigger your risk of:

a) losing out on further earnings / expenses;
b) being implicated in questionable activities - now you know the score with these people you can't claim to be innocent of what's going on there;

Up to you whether you then choose to do anything further about reporting them to HMRC, etc., for what sounds like fraudulent activities...

Get out, fast.

The guy is obviously pretty unscrupulous and the longer you spend with his operation, the more you will become exposed to being implicated in his activities.

At the very least, you will probably not be paying over the correct PAYE and NI due on your salary.

Do you even know under what terms you have joined his organisation i.e. does he look on you as an employee or some sort of self-employed contractor (or does he even care)?

I did join as an employee or so I was told, although I haven't had a job offer letter or a contract of employment, so I guess in his eyes it may be different? I know I just need to walk away and I suppose there is no guarantee I will get paid even if I stay ! What a st situation frown

Look for another job straight away and get out at the earliest opportunity.

How many months have you been there?

Have you received any wages/salary payslips?

Did he ask you for a P45 from your previous employer?

It sounds like he hasn't bothered with a formal employment contract.

I have been here just under two months, I have received wages in the the form of cash paid into my bank account. He did ask for my P45 on the 30th of May so he could sort my wages out for the 31st - Which I wouldn't have thought would be long enough to make any difference? No hope of a contract ! to be honest I'm not even sure who the company is registered to, but some post arrived this morning with his middle name as his first (if that makes sense) smash

A similar thing happened to me a few years ago. I hadn't been made redundant but I did have a secure job for an offer from a new company who were looking to expand in London and I was to be their first London based employee.

I handed my notice to my current employer and then, as soon as I got home, I had an email pop up from my pal who was working for the firm at another site telling me to not hand my notice and he'd call me as soon as he could.

Call comes in and it turns out that the guy who was taking me on was a convicted fraudster and, at the time, was wanted for various crimes. The sly git had even gone as far to have his name being blocked on Google searches, I found out the true extent of his crimes through Yahoo!

It was utterly crap at the time but sparked a total career change for me which has really paid off.

Anyway, back on topic - I think you need to just walk away OP, it's what any sensible person would do. Write the cash off and spend all your time looking for a new role instead, much easier that way.

You didn't tell me if he had given you any payslips?

Have you agreed a weekly/monthly GROSS salary with him?

Are the amounts being banked into your account in line with what you would expect your NET Salary to be.

If you have received payslips, are the amounts on the payslips in line with the actual amounts you have received?

No payslips even though I have asked numerous times for them, we agreed an annual basic salary + comissions as and when. The amounts being banked seem a bit light but I have nothing to go on as to why ? frown

On the assumption that your normal 2011/12 PAYE tax coding should be 747L (the standard) it would be dead easy to work out what the Net Salary should be for each month. Why not give me the details through an e-mail and I can work out for you what it SHOULD have been .
