E92 335i Dropping/Vibrating window at high speed

Just wondering if it will be covered under AUC warranty:
At high speed (130+) the drivers window seems to drop a little and make a very loud whistling sound. In addition at speed it can be seen vibrating in the top corner where it meets the B pillar. When I slowed down (80ish) the sound and vibration remained. Lowering the window slightly before putting it back up resolved the problem. I am yet to get back up to the speeds that caused it but am wondering weather it would be covered by the AUC warranty on the car (07 plate, purchased from a main dealer nearly 6 months ago) or weather BMW would investigate the fault - it doesn't happen on the passenger side/shouldn't happen really
