So I have been clamped by a cowboy who wants £120 in cash only, he is refusing my card as HIS machine does not work. He said he will be towing my car away. I'm staying in my car!

What to do, I'm bored!

Call a few friends and beat the st out of him, but stay in the car in case of CCTV

Keep him distracted and get someone to clamp his van, afterall he must be parked in a clamping area.

Assuming from your post that you expect to have to pay the £120, why not just use your card to get the cash? Or will he tow your car as soon as you leave it?

This I like.

However, you do know that you are legally entitled to remove the clamp as long as you don't damage it, don't you?

Very easy to do;

1. Jack up clamped wheel
2. Deflate tyre
3. Move clamp to one side to access wheel nut
4. Undo all wheel nuts and remove wheel with clamp
5. Pull wheel off clamp
6. Replace wheel, pump up, drop off jack and go home.

Get a mate to bring a metal cutting device to you and when dark and no one around set to and cut it off. Leave the chap a note for the morning with a statement that you witnessed some chav trying to pinch the wheels but it turned out to be some 'pie key' after the clamp to weigh it in. Car now free for you to remove when you checked on it in the early hours. Good reliable friend as a witness. Wear dark clothes and a hoody. Job done.

Ok maybe it will not work to your advantage but it will pass the time and kids don't try this at home!

Do not want to pay cash, they accept card and I would pay via card.

At no point am I refusing to pay, I am simply wishing to pay via card; a method which they state they accept.

It is not my fault THEIR machine is broken
If I leave the car it gets towed

Presumably the longer you stay in the car the longer his clamp isn't earning him money elsewhere...

Why not just ring for a recovery company to come and recover your car for you? Get them to put a dolly under the clamped wheel, and just take you away to a garage where you can have the clamp removed without damaging it. Then you can return the clamp to the clamper and enjoy the look on his face.

It's not National Clamps is it?? i had similar a few years ago firstly he didn't have his security badge CIS i think same as the one doormen have so it was illegal to clamp in the first place. As time went on i needed to get moving so agreed to pay but his machine wasn't working so they have to release your car if you have made a genuine attempt to pay but they can't accept it. Because of faults with there equipment in the end i wasted 3 hours with them and took legal advice a few days after and they refunded me the cash i had to pay them and i recieved another £200 as compensation.
