Requirement to NIP the driver?

RTOA 1988, Section 1 requires that the RK or driver be NIPped.
Even if the RK is not the driver, eventually the driver usually does get his own NIP. However, I can find no legal requirement that the driver actually is NIPped if the RK has been. It does seem strange given that the purpose of the NIP is to bring to the accused's attention the possibility of prosecution whilst events are still fresh in his mind.
Is there a requirement somewhere?
