Do you need a DPF to pass the MOT?
Discussion
Chaps
Just mulling over the idea of removing my DPF on the old E39 (530d) and replacing it with a straight-through pipe).
Instead of having to replace come MOT time, my question is, do I actually need it to pass the MOT?
I was goiong to combine this with the purchase of the upgraded downpipe from Ecotune. See if I can't improve my mpg somewhat.

This is the universal legislation that is planned to be brought in and there's no mention of only applying to vehicles manufactured after a certain date: http://eur-lex.europa.eu/LexUriServ/LexUriServ.do?...Section 6 states:
(6) This Recommendation is a first step towards a uniform assessment of the deficiencies identified during roadworthiness testing within the Union.
Followed by:
Member States should assess failures detected during a roadworthiness test of a vehicle in accordance with the guidelines set out in the Annex to this Recommendation.
As for removing DPF's:
8.2.2.1. Exhaust emission control equipment
(a) Emission control equipment fitted by the manufacturer absent or obviously defective.
So as I read it, if it was originally fitted at the factory, it will need to be fitted to pass the test.
Ah. My fault! I inadvertently looked up my boss's 04 plated E60 5 series last week on real oem and forgot that I'd looked up his (i bought him the eco tune downpipe for his car - he's very pleased with it by the way - had it fitted on Friday).
I then mistook the two catalytic converters (the secondary ones - not the tiddlers on the downpipe) for a DPF on mine.
So apologies all around - I'll get me coat etc etc.
Still - at least it's created a small debate on the topic!
