I don't know if this topic appears ne where else and i can't be bothered looking.

Any way does anyone know how/why uk motoring laws apply to the m6 toll when it is run and owned by a private company. indeed would it be possible for another private company to open a road and dictate its own laws?

AIUI, it is not owned by a private company. It is managed, financed and operated by a private company, but ultimate ownership still resides with HMG.
However, it dosen't matter anyway as ownership is irrelevent to whether road traffic laws apply on it, toll bridges being a clasic example. Several issues ago of the TSRGDs, ownership did make a difference to the signing requirements.

Yes, but nobody can dictate their own laws. However, as long as they didn't allow any members of the public onto it, road traffic laws would not neccessarily apply.
All a rather pointless debate though.

So if members of the public weren't allowed on the M6 Toll, but members of the M6 Toll Club were, and paying the toll gave you temporary membership of the M6 Toll Club...?

I'm surprised that anyone bothered to reply after this statement. There are a number of posts on this ... search for them ("m6 toll" in SP&L for "all dates" returned a page of hits) - it's not difficult! - Streaky

Correct. A private company has a contract with the HMG to build and maintain the road at their cost in return for the right to charge for its use. The road however remains the queen's highway.

It is of course a cynical scam on par with the early introduction of scamera's. In isolation you can not argue with it but in 10yrs you will be bitching like hell about being satellite tracked and paying to use the road as well as your car.

You have a duty not to use it.

I Totally agree! And if NO-ONE will use this Abomination of a road, or any other of its kind. We may yet retain free movement in this Godforsaken country of ours!

we will NEVER enjoy the same freedom of movement we had even 10 years ago,no matter who owns the road or whoever is in charge of (whats left of) britain.

Well, the government thinks it's to reduce the rate of traffic growth! Quoting from a response [by unknown - S] to the consultation (on extending the period for charging tolls):

"When the undertaking was made that tolls would cease, the huge growth of traffic that has taken place at the Crossing was not foreseen. To cease charging at the Crossing would lead to faster traffic growth, increasing the congestion problem at the Crossing. Therefore it would, at this time, be imprudent to remove charges. However, this situation will be reviewed once decisions arising from the M25 area multi-modal study (ORBIT), and those regarding future Thames Crossings, are implemented. Legally, the charging scheme will not contravene the 1988 Act since charges are being introduced under different legislation [Statutory Instrument 2002 No. 1040
The A282 Trunk Road (Dartford-Thurrock Crossing Charging Scheme) Order 2002 (made under powers granted in the Transport Act 2000) - S
]".
