Caught on A40 near Raglan - options please !
Discussion
I was recently caught by a mobile unit facing the oncoming traffic, they alledge doing exactly 90mph on a dual carrigeway. (Gwent Police)
The camera van was parked in a layby on a long left curve.
I had a large renault MPV on my inside that I was overtaking. As a result I didn't see the camera van (and it couldnt have seen me) until a short distance before it.
The questions:
1) How much seperation does there need to be between vehicles to ensure the reading is from my vehicle, not the other one ?
2) How long do they need to have a fix for a reading to be valid.
3) Given that I was close to the camera before it could see me, can I claim that the 'camera panning' necessary could mean an incorrect reading was taken (especially given the blue MPV so close).
4) I assume that the 'don't know who was driving' is out of the question given the forward facing camera.
5) Can I ask for a copy of the photograph, *before* electing to sign the NIP. I.e. "I can't remember who was driving, but if you show me the picture I will be glad to help if I can"
6) I've got a totally clean licence - is it easier just to take the points/fine ?

Chuck the NIP in the bin. Demand a photo, if it's not recognisable use the Hamilton defence. Just be awkward and drag it out, they might give up!
Anyway isn't it a dual carriageway at Raglan - you were only 20mph over the limit anyway, so you won't get a ban if the worst comes to the worst.

1.Unfair to ask Bib and others to pontificate (dont do that wearing cuff links in a submarine) as it depends on what the Operator saw in relation to the use of the device at the time.
2. If 1 above was Rule 1 then Rule 2 would say Rule 1 applies.
3.Rule 1 applies.
4. Depends if they will alow photo to show YOU were the driver. At the initial stage not obliged to do so but some do.
5. You can only try. See later part for Rule 4.
6. If you have that Virgin Licence it is not hard (well yes it is for I have been in your boat on a DWL)
to admit fault. You may have voted them in that make these laws?
