Chocolate isn't the defining thing, it's whether it's a luxury item or not - eg chocie biscuit would be taxed, chocolate cake wouldn't be. I'm a regular mine of useless information.

Boring answer - it depends on local tax classifications, so either - or neither - depending on where you rest your hat.
UK tax definitions are pretty clear cut for it, US ones a little different. In the UK it's simply labelled as a confectionary VAT wise, which is standard rate. In the US, for the purposes of sales tax, you've got what's known as the Twix Tax Test - no really! - which basically states that if it's got flour in or it needs to be kept refrigerated at the sales outlet, it's not a candy bar. It's sort of like the US' own version of the great Jaffa Cake vs HMRC legal battle.
