New speeding laws

Am I right in understanding they're now NOT going to penalise you for doing 35 in a 30mph limit, but to compensate their gonna 'up' the penality for minor offences on faster roads. So, doing 116% of the speed limit in a built up area outside a school is now NOT illegal, but exceeding it by just 10% on the classic 'deserted motorway on a clear night at 2am' is now considered worse than before??

I am wrong, surely?
