Hire Car: Legal advice
Discussion
Mods, please leave this here or put it in the lounge, I need a question answered.
Hi, I have been on here for over 8 years and have in excess of 10k posts. I have used a different login because I don't want my identity known.
Just over a year ago I had my expensive car written off outside my house, on the road, by a drunken driver. The third party insurance paid out for the car. I used a consultancy to deal with it and they gave me a hire car for the period, which was much lower spec than my car.
Well, the third party insurer has not paid the consultancy for the hire car which is now going to court. I have a ststement that I need to sign for the hearing. There is one line in it that says that..."I confirm that it is my signature on the agreement and that I am personally liable for the hire charges"
Now, the solicitor has said to me that I will not be paying the hire charges even if they lose. But I must say that I am very worried about this.
Anyone have any input on this?
Many thanks

Maybe get the solicitor to put this in writing? I am no legal-eagle but 'the solicitor says' vs a signed statement are two very different things.Wayne E Edge said:

Does the agreement that you signed say that you are personally liable? You did read it and understand it before you signed it, didn't you?Hi, I have been on here for over 8 years and have in excess of 10k posts. I have used a different login because I don't want my identity known.

Was it a like for like car?
Did you keep it only as long as you needed it?
Was the hire rate competitive?
Credit Hire. The papers you signed for when you got the hire car will confirm that you are responsible for the hire charges.
Credit Hire charges are much more expenses than off the street hire companys and this is the reason your case is going to court, the other party insurers are not prepared to pay the inflated prices, no doubt.
At the end of the day, you are responsible for the hire charges, but as long as you do as the hire co and there solicitors advise, there is never any come back.
I wouln'd worry about it.

No
Yes
Don't know
It says personally liable on the solicitors letter although he says I will not have to pay. I have not signed anything yet.
What does the agreement itself say?Yes

What is a similar car available for today with the usual mob (Hertz etc), compared to what your consultant was charging?
