For that price, and for 7-seats, you're looking at a series-1 version. They had a lot of bad press but I believe the problems were only really present in the early ones. I see a few around here which seem to be going well, including a really cool 500.
Would be worth checking on one of the Mercedes-specific forums before jumping for one of these. Whilst there are undoubtedly good ones out there, you could inadvertently buy a crapper.

There are a few problems with the Mk1. Like the pin that the accelerator pedal pivots on is plastic and so brakes.
The 270 CDI is good but the inlet manifold needs replacing every so often! They were better after the face lift but the factory got millions spent on it before the mk2 came out to fix all the production problems.
I own and 03 270cdi and it dose drive well but after a BMW I think you will feel a little let down. Having said that if you shop about and push the seller you can get a lot of ML for very little cash.

I had an ML320 and yes, whatever you hear about poor quality is true.
I thought it was the worst car I'd ever owned - at the time it was 2 years old and squeaked and rattled as if it had been to the moon and back, the rear two fold-down seats were only useable if you didn't have any legs and if in the down position the boot was pretty much unusable. The materials looked like they'd come from a pound shop, thin squeaky plastics with cheap leather. The chassis was awful with the most appalling thumping and banging from the suspension as if the engineers who'd built it didn't understand unsprung weight. The electrics were flakey at best, the folding mirrors had a mind of their own and don't get me started on the seats.....
Although I would admit that it didn't actually break down over the 6 months I had it, I would suggest that either a really, really extended test drive/inspection or buying an MPV or upping the budget and getting a Discovery 3, if you really do need the space they're much, much better than an ML....
