Hey guys,

I was wondering whether someone can help my gf's mum with an issue (no not that type of issue lads, calm down).

Her mum is married to a bit of a bellend, he has amounted quite a lot of debts, one of which is for a an M&S credit card. So, M&S have obviously summoned this guy to court which he's ignored as now my gf's mum has been summoned to court instead.

Can anyone tell me where she stands with this, it's not a joint account or anything. Will she have to pay?

She should ask for a copy of the agreement/application she signed.

If its not a joint account and she didnt sign anything then she cant be liable.

If she has been ordered by the Court to attend then she should go or the Court could issue a warrant for her arrest.

It is possible she is being order to attend as a witness, as she can't be held liable for the debts in her husbands sole name.

She's not liable for repaying his debt, but she probably is for the spending in M&S.

I hope the outcome's a positive one.

Without knowing exactly what it says on the notice of hearing it's more likely that M&S obtained a judgment against the husband which (if they jointly own a property) they are trying to secure against property with a charging order, or alternatively they've already got this and are trying to obtain an order for sale (less likely).

Ah cool, I've just read up on what a charging order is, found some info here:

They do own a property jointly, so I'll find out exactly what the summons says.
