On 5 May this year I took delivery of a 2 1/4 year old car with 30k on the clock

Last week the clutch started to slip in 4th and 5th gear on occasions, the mileage is now 43k

I'm pretty sure that the warranty will be useless (wear & tear) but I have read somewhere that if a fault develops within 6 months, the suppying dealer must fix this.

On 3 November I sent a recorded delivery letter to the service manager reporting the fault.

Does anyone have any idea if I have a claim against the dealer here ?

The dealer is a main dealer a little way away, but there is an accredited servicing and repair centre that can handle warranty work in my village and this will be much more convenient and cheaper if the opinion is that the dealer has no liability.

That's not a fault. Do you want a set of tyres out of the dealer too?

Make sure he does the brake discs and pads too. And brim the fuel tank.

I bought a can of coke yesterday, I`ve drunk it, didn`t seem to last very long. I went back and complained and the bd refused to give me another one. Unbelievable.

Well the clutch wearing out can't possibly be your fault can it


So logically it must be my fault


So please send me a letter and i will pay for it

Even with a new car warranty, some manufacturers stipulate that the dealer has to get prior authority for a clutch related fault, will have the parts on mandatory return and will only accept the claim after they've inspected the parts.

It depends as to what part is at fault (it could be the clutch or something not related like an oil seal), which cannot be determined until the box is dropped and by then if it's unclaimable you would have incurred labour costs.

With a used car that you've had 6 months and put 13000 miles on, the chances of having the job done under warranty is remote to non existant.

Thanks for all your replies to this

Whilst I am a touch annoyed that having spent (for me) a fair amount of money on a newish car I find myself with this problem, I can also accept that the car is now nearly three years old and that I have covered 13000 (motorway) miles and that I did not know how the previous owner treated it.

Take it to the local authorised repairer, get it repaired, move on, lots of things more important in life

to be fair, the Dealer would have no way of knowing how you have treated the car in those 13,000 miles.

When I was a Driving Instructor many years ago, the original clutch in my Nova was changed at 83,000 miles, solely because of a noisy release bearing. The rest of the clutch was virtually as new.

I saw several cars of exactly the same model for sale, with less than half that mileage stating that a new clutch had been fitted.

I do about 12k a year and I've never gone through a clutch so it's possible it's faulty just as it's possible that it's simple wear and tear due to yours and the previous owners driving styles.

That said, I'm pretty sure you won't get anywhere trying to make a warranty claim, but depending on the type of purchase (main dealer approved scheme where you may expect some "goodwill" vs. aftermarket AA warranty) there's no harm in asking the question - they're a car dealer not your best friend, the worse that they will do is say no.
