Hi,

Sudden issue, out of the blue my wife has found a buyer for her car, but despite me pushing her to do it, she hasnt transfered the private plate from the vehicle yet! (yes, I know this was wrong / silly etc etc - arguments have already happened about it!)

The buyers want to come to get the vehicle tomorrow. What options do I have?

1. If i type up a letter stating that the plate is NOT included in the sale, and that he has no right to it, which we would both sign and such, would that have any legal standing?
2. If he agrees to take the car without the V5 but he fills in the new keeper section, and I take it into the local DVLA office monday morning, and get the plate on retention, would the new V5 be sent to him directly? and would the plate be safe?

This is a right PITA situation, and I annoyed at her for slacking off getting it done, but whats the best way to solve it?

Any help appreciated!

When I bought my current vehicle we had a similar situation, the guy I bought it from hadn't done anything with his plate, we agreed to him sorting out his transfer then sending me the V5 once he got it back, then I had to transfer my own PP on to it. We had spoken to DVLA who just said that this should have been done before the sale as technically once I had paid for the vehicle his PP was legally mine. What we did was probably not quite to the letter of the law & required a fair bit of trust on both sides, so if you don't have this you need to postpone the sale until you can go into your local DVLA as they can sort it out while you wait AFAIK.

Believe me; I have learnt the hard way on this one.

Go on the DVLA, Gov website. Down load the form to place the no on to a cert of retention, send of the form with the V5 and 25.00. Takes around 2-3 weeks to get the cert back

Take a copy of the V5 to give to the seller, inform them when you get the V5 back on the none cherished plate, you will forward the log book on to them.

Ensure that they sign a receipt for the vehicle.

this
you can not do it at your local dvla anymore, you can take the docs in but it will still need to be sent of, takes 2-3 weeks

How strange,

I repeated the exact same process this month as set out above, on my reg no 4DX from the V5 on my Porsche on to a cert of retention , ready to go on to my LP700 early next month. All within 7 working days….

You will hopefully get lucky & it will get done quickly though i have just had a retention request called in for inspection (an unlucky dip exercise) & the 1st date is the 10th January given all DVLA offices are closed between Crimbo & New Year. It is the 1st time this has happened in all the years I have been doing this though. Good luck wink
