No injuries and no fault on my part. third party insured (a commercial vehicle). My insurer is offering me two options:

Uninsured Loss Recovery, where I pay the excess and they recover it from the third party.

vs

Non fault service assistance from a third party where no excess is payable and they chase the third party (they're recommending).

Car is an 04 BMW with an extended warranty if this is of any relevance.

What do I need to know?

The second option earns them a commission and costs the third party potentially a lot more in fees. Go for the first if there's no question of liability. Who are you insured with?

Alternatively if there's no question on liability contact the third party's insurer direct to arrange for them to pay for repairs.

What's his incentive to do so? 1st option means he has to pay out his excess.

I get it back so I'm not too bothered - I don't believe in milking the cow on this.

yes Why put someone through extra expense (and probably stress) if they have been compliant?

My insurance company never asked me anything like this when someone crashed into me. I just called the claim line and they sent out a recovery vehicle and got the car taken away from the scene.

They can work out liability very quickly via computers (after receiving a description) and also obviously if the other party is admitting fault

is it not best to confirm first in writing from the other insurer that the other party has admitted fault conclusively before paying any excess, etc?

Also what was the damage exactly (is it a write-off?)

This happened to me a while back and Elephant only offered the second option. In my experience, choose the first option.

Long story, but I ended up having to go to court for a non-fault accident where I wasn't even in the car when it was hit (was parked up while I was at work) because of Elephant. Thankfully I won.

I see - you pay the excess initially and then get it back from the other's insurer. Fair enough, as long as you're not out of pocket!
