Hello,

I am hoping someone can give me some advice as I have never had any experience with insurance before. I have a Ford Fiesta, I was switching from left to right line, woman stopped to let me go (in the right hand lane, and was busy with traffic). I pull out and am half in half out of both right and left lanes. Gets impatient, tries to go round me and doesn't notice oncoming car, comes back in and touches my wingmirror only folding it in.

Pulled over, looked at damage, was only a tiny scratch/scrape to hers on the passenger door, nothing else. Exchanged details and reported to insurance same night etc. Then calls me up saying she wants £2.5k in cash for all the damage caused or it'll go through insurance. This was to a 4x4 by the way!

Anyhow, got a letter from insurance today saying after review am being held responsible for the incident, will lose no claims etc etc! There is literally no damage to mine, a tiny mark on wingmirror that you can't see.

What do I do next, obviously call insurance but what to say? Ask for an inspection?

There just trying it on, tell your insurance and let them deal with it.

Still ongoing, claim is now for a total of just over £6,000! This is all car damage to there side, no injury or what not claims.

Won't provide me with a breakdown of exactly what for, they can't contact third party and they don't have any images from the third party. (So I'm told)

Any ideas exactly what to do, after a lot of moaning they seem to be reluctantly looking at it again. However to note the damage scratch didn't even go down to the primer and there were no dents.

Edit : They have inspected my car and have photos of this, clearly a tiny scratch/mark to a wingmirror which doesn't even need replacing!

They're probably driving round in a hire car until it gets sorted - 50 days hire of a Q7 is probably around the £6,000 mark.

Don't you just love accident management companies!

Ask to see evidence of the damage, and witness statements

Why are your insurers contacting you exactly? For your authority to settle the claim in the other parties favour?...they don't need your permission. Furthermore you aren't counter claiming against the other side so they won't prejudice any claim for uninsured losses made by you.

I would suggest that without any documentary evidence including engineers report to support the other parties claim your insurers won't pay anything out to the other side. I'm sorry but I can't see here what exactly the problem is?!..unless it is your insurers are looking for your support to argue the other parties claim quantum.

Can you expand why your insurers are in communication with you?

Next time take photos on the spot of both cars.

Thanks for the replies guys.

To answer some questions, we're both with the same insurance company so its all in-house. There is an engineers report but there are no photos?

Yeah it is being dealt with by an accident management company as they phoned me but I refused to speak with them. I know the car has been repaired and given back to them already. Unfortunately the light was awful against a dark car so couldnt see anything anyways; plus there wasn't really any damage looked like plastic residue from the wingmirror that would just rub off!

Also, it is me who has been in regular contact with the insurance company to make sure they don't pay out and keeping updated as renewal next month and going to have this hanging over me.
