I just bought a bmw 320d for my daily driver i pick it up next week, i agreed the price with the dealer and included in the price were new mats, repair of a tiny dent on one of the panels and 4 new tyres,as well as a nice cash discount. i called today and he said he just got the 2 new tyres and had them fitted (Bridgestones Run flats) as the other 2 did not need doing, when i viewed the car i did thouroughly check it out and imo all 4 tyres needed doing, as the dealer agreed to change all tyres but has now only changed 2 should i make a fuss and make sure he puts on the other 2?

If four new tyres are what you agreed as part of the deal, then tell him the deal is off unless he keeps up his side of the bargain imo.

i was worried he may try and keep my deposit

He is the one breaching the contract, he would not be entitled to do so.

Did you stipulate 4 new tyres in writing?

Just tell him, the deal was four new tyres. If he tries to keep your deposit, you report him to trading standards. It shouldn't be an issue, if he wants you to buy the car he'll put the other two tyres on. Just be firm but fair with him, a deal is a deal. If he won't put the tyres on, just tell him you'll pay whatever you agreed minus the cost of the two tyres! Make sure he does the other things agreed too, and confirm when resolving the tyre issue what else was agreed, maybe get it in writing!

no it was all verbal and he has not said that he would reneg on anthing just that it did not need 4 tryes again i feel it does, the last thing i want to do is buy 2 new tyres in march

TBH I think what you are seeing is fairly common practice as I had a very similar experience when buying my previous car.

The dealer knows you want the car. He thinks he's got the upper hand. As a result is trying his luck at scraping back a few quidfrom what you initially shook on.

Stand your ground and I'm sure everything will be fine.

cheers agreed its not a cheap car and there is another one that is very similar with less miles and slightly newer so i can find another, its not as if 320d are not common.

When I purchased my previous car from a dealer I got them to agree to refurb one of the wheels as part of the deal. Turned up on collection only to find it hadn't been done - they said it was only cosmetic and wouldn't corrode (it looked like it had been scratched by a wheel gun whilst taking the wheels off and subsequently retouched).

I pointed out that wasn't what I agreed to and the only thing they could come back with was that it was fine and wouldn't corrode. When asked to put that in writing on headed paper they rapidly changed their tune and had it done.

So I'm afraid the other posters are correct - they think they'll get the deal by only replacing two of the four tyres - you need to show they won't. frown

On another note: be prepared for a set of £50 a corner ditchfinders. My most recent car was given 3 new 'Sunny' tyres. Geeee....thx

i am calling him first thing in the morning funny thing is after i asked for 500 off the car my finanve deal went up by 8 per month i am going to check they have not added that figure to the finance

They have simply increased the rate and therefore there commission, almost certainly recouping the 500 discount

OP, have you tried your bank for a loan to see how their rates compare? I found my bank to be cheaper than the car finance and then you can really throw the dealer off-track by changing your mind last minute and offering him the cash (read: debit card) for the car instead.

Just use 14 day cooling off period if you want to get the deposit back.

no i can't remember the finance company the bank loan was only slightly cheaper and they wanted me to jump through hoops it would have taken me a couple of weeks to get it sorted,
i am going to have a proper chat in the morning and if i don't get what i want i am walking.

Sounds best course of action mate. As you say there are plenty of other 320d's out there and it does sound like the dealer is being a bit slimy with the whole deal.

There isn't one, he viewed the car, the deal is not done at distance.

He has time to cancel the finance and pay in a different method but as standard there is no cooling off period.

Yes, make a fuss as the seller is in breach of the contract of sale you both agreed upon.

As others have said though, they will eventually buckle - but will "honour" the agreement with the least cost possible to themselves, so unless a make and model of tyre was stipulated, expect El Cheapos.

So they granted the £500 "discount" (so the cash price on the agreement and balance financed reduced by that amount), yet the agreement became more expensive?

So it hasn't just gone up by £8pm, the increase also covers the reduction in selling price, so assuming a 36 month agreement, they've actually increased it by £21.89 per month.

I'd be mentioning their FSA obligations to "treat customers fairly" and make a formal complaint to the Financial Ombudsman after giving them an opportunity to revise the figures back to their original ones less the £500.

Were you given the Pre-Contract Information and were all the Ts & Cs highlighted and read aloud to you etc? Have you signed the contract and taken delivery of the car yet or are you between deal and signing/handover?

I will assume this is not a franchised BMW dealer operating in this manner, but an independent of some sort. Not based in Kent are they I suppose?
