Advisery now, in effect from May I think but I don't have the paperwork at hand.
Also they don't have to have them, it is a tricky one, if they are fitted they must work, there is also a first use date and a specific lumen output on the lights.

For some reason PH isn't letting me quote Puddenchucker's post above but that bulletin was produced by VOSA in March 2011.
By the time of the final draft of the proposed 2012 Testers Manual in November they'd changed their minds and the Manual was drawn up to reflect the position given by Athlon.
The change probably came about after one of them actually bothered to read the (non binding) EU directive they were supposed to be basing the new rules around:

Section 4.1 which deals with headlights leaves it entirely up to each country to determine their rules on self levelling suspension & headlight washers. VOSA's stance had been that they were being forced into this by Europe yet this was blatantly never the case.
At best incompetence, at worst a protracted lie to lead the public into bending to the will of a small team of bureaucrats with who knows what kind of agenda and absolutely no legal standpoint to work from.
Just fills you with confidence about the agency in charge of our MOT scheme and commercial vehicle operators doesn't it?
