Contract of employment?
Discussion
In a nutshell:
Started working for a company in August 2008, had no official contract. At some point in 2009 I signed a contract that was then held on my personnel file.
In June 2010 the company was bought out by the company I still work for now.
Certain aspects of my original contract have changed such as place of work/hours of work/benefits and remuneration (ultimately to my loss).
I have never had or signed a new contract since the aquisition so wondered where I stand? Does my old contract still stand or does some period of time in the current organisation mean i'm under a default contract of theirs?
Can anyone help clarify?
Thanks,
Rob

Your contract continued the same after the acquisition as before it.Started working for a company in August 2008, had no official contract. At some point in 2009 I signed a contract that was then held on my personnel file.

Well I did think that was case. They've just mentioned 'contractual reporting' so I thought it was a good time to remind them I don't have one!!
Problem is if I challenge anything i'm marking my own card and will more than likely line up my own exit. I was basically told by one of the Directors when they took a particular benefit away that it's tough s
t and if I tried to do anything about it nada nada nada...
Hey ho.

Bought out... To my understanding the company I worked for was called (for example) 1111 Ltd, it was then run under licence in the name of 2222(location) Ltd (when this companies name is actually 2222 Ltd) from June 2010 to December 2010 operating with the same company number and VAT reg'n number as what 1111 Ltd was. In December 2010 it was hived up into the main 2222 Ltd business and at that point took on 2222 Ltd's company and VAT number.
Come to mention it I did sign something with some referance to TUPE which was (from memory) something about representation...
Ah, found it...
"(iv) The proposed transfer would affect all employees of *** who are currently employed in the business. They will transfer to the Buyer under TUPE 2006 on their current terms of employment. Their period of continuous employment would be preserved. There are no other legal implications for Affected Employees. "
The letter I signed was basically to choose whether I wished to nominate a representative to relay information reference the 'hive up' or receive the information myself (which I chose).

In which case I would have expected you to receive an updated contract detailing the name of the company which you are now employed by (ie paid by), confirmation that the transfer is treated as continuous employment, and a reference to your latest employment T&Cs (there may have been some "harmonisation" as part of the transfer so some aspects of the T&Cs could have changed). If you didn't get that then I see no harm in asking for a copy and your current T&Cs. Your problem, if any, is what your response will be when HR asks you why you want a copy.
