Of the Human rights bill/Act ?

A worki colleague of mine went to court over a speeding offence after he was told that it was illegal to state 3 points £60 on an NIP and for the prosecution to later up that amount in court.

The beak apparently ask him where he heard it from, as not a lot of people knew that.

Unfortunately he didn't get a chance to try it out, as the scameraship had ballsed up the evidence, and AND, had to pay him compensation for the stress caused.

BUT, i have it on god authority that it is still the case that the £1000 fine is not legally on.

Anyone any wiser?

Article 6 CHR has nothing to do with upping punishment and deals with matters relating to ensure a fair trial.

Article 7 deals with unfair punishments that you mention. However it does state that matters not prejudiced if punishment is laid down at law.

IIRC then Fixed Penalty punishment is catered for at law under a Statutory Instrument and that the punishment for speeding at Court by an Act of Parliament. I submit, as a layman, that Article 7 does not apply to what you state?
