The 'banned - now what?' thread started me thinking about my own case: I was convicted of careless driving by magistrates a little while ago: my points - can't remember if it's 3 or 5 - were and remain hand-written on my licence by the Clerk of the Court, I received no written confirmation of the judgement either on the day or subsequently, and the 'bill' for the fine and costs was scribbled on the back of an envelope by one of the ushers.

The only proof I have that I paid the fine is the counterfoil from the bank at which I paid it.

Now it was late, the case having taken all day to hear and the bench having deliberated for 3 hours, so I'm sure everyone wanted to get home; but it all felt a bit unofficial, to say the least. Is this mormal practice?

Fines sometimes paid there and then at Court, but not liked and indicates a rich man. Usually fines paid to Mags Clerks Office. You must have been given something to present to the Bank so that they could credit the Fine account?

As to handwritten endorsements on your Licence, Mags Clerks would have to notify DVLA of that fact. Did they do so?????????

If you lost your licence had had a replacement, you'd see whether or not the points had been put on...The price of a replacement paper attachment part of your licence would be less than 4 years worth of extra insurance premiums.

No don't become forgetful, will you...

I don't have it here but as I recall the back-of-the-envelope note told me who to make the cheque payable to - no direct reference to me or my case though.

I do occasionally wonder what I would do if the bailiffs turned up one day to distrain goods to the value of - a bank counterfoil isn't exactly going to persuade them to go away, is it?

As to whether the Clerk notified DVLA I have no idea - one day I might get round to 'misplacing' my licence so they have to send me a new one, as Streetcop suggests, and then I'll find out.

Oddly, this seems to have had less impact on my insurance premiums that the last SP30 that I had (now expired)...

Even more oddly the bench were deliberating for so long that the Clerk advised all present to push off for a bit - I went out to get something to eat and ended up sharing an enjoyable sarnie with the prosecuting counsel: all very civilised...

I found out that 6 hand written points I earned about 6 years ago (one offence of 95 - 100 on motorway) never reached the DVLA - I changed my address a couple of years later and got a clean license for no extra charge. I was also in the 2 year driver probation period but never had to resit my test - I had a 14 day ban during which time the court held on to my licence - needless to say I was on rather good behaviour for the next few years!!

I did tell insurance companies that I had the points for several years after to make sure I was covered - they never commented when I sent them a copy of my clean license.

One friday afternoon a few years ago I was arrested by a local policeman ( and no disrepect here, but at school he was a nasty type) who recognised me from a notice he had seen at his station.

It wasn't like I am a master crim, my only contact with the police generally is to pay the odd speeding fine, which if you drive quattro's and cozzies over 25K p.a. is easily done.

He stopped me and insisted I got into his panda car and too me to the local nick for not paying a speeding fine. He refused to allow my wife to drive me there.

Once at the Nick, I was formally arrested (by my sisters father in law, just to make matters sweeter!)/

I insisted I had paid the fine ages ago and sent my very upset missus to get the receipt from home.

In the meantime, the plods had got managed to get confirmation of my payment from the court office, some 5 mins befroe they closed on the friday afternoon.

Naturally they released me immediately, but the worrying part was that if the court office had been closed, I could have been kept locked up until they re opened.

I was pretty annoyed, especially as the plod could just as easily arrested me in my favourite restuarant with my children/friends etc.

Anyway, I put a claim in for wrongful arrest which more than paid the fine....

The solicitor, as per usual, made the most.
