but I'd love to bring a claim against my local council for failing to grit a main A road which resulted in me skidding into a low life at less than 5mph. The damage on his car could be fixed for less than £100. My damage repair is costing £100.
There is no whiplash but it seems he and his three passengers can't resist a few thousand pounds each. And his repair is being done by 'his people' at, no doubt, exorbitant rates.
I know I should have kept a bigger distance between mine and his car. But I paid a shed load of tax last year and the fact main A roads are not being gritted is pissing me off!

Just utterly pissed off that we were told days in advance that snow would fall on Saturday after dusk. And my local council did no gritting which I would count as appalling service.
My sympathies on the fraudulent claim. Did you take photos to show the damage (or lack thereof?)
But I do disagree about the claim against the council. I think people generally need to take more personal responsibility, and try to get away from this compensation culture. If you were able to claim against the council, it only exacerbates the problem... I see it as almost self defeating. "I'm getting sued. Bugger. It can't be my fault, who can I sue?"

Whys he a low life, is it because his car got in the way ?? or is it because he has the cheek to be pissed of that you were driving too close to the rear of his vehicle in atrocious conditions and now his car has been smashed up??
I really hate these yobbish fellows, I'm totally behind you. In fact don't stop at sueing the council, if the government hadn't given this yob a driving license the accident wouldn't have happened sue them as well.
Do you not see that criticising him for being litigious in the same breath as asking for advice on how to sue somebody, is possibly going to leave you open for a bit of well deserved piss taking on this forum?

Some idiot slowed down and turned left in front of me today without indicating, we were both on snow and i had a moment where i thought i might not be able to stop in time. After shouting at him I realised it was me that was fault But I do disagree about the claim against the council. On Saturday morning I noticed that around here the car tyres were white, as was the road surface, suggesting the council had been gritting.
Once the snow started then i saw no sign of gritters.
HOWEVER I also gritted our drive with salt befre the snow came and once it did - it made no difference whats so ever,
This tends to support the claim I've heard from council officials that it doesn't work below certain temperatures or conditions.

I'd put a claim in about it, same as if I bent an alloy from a pot hole. However lets be fair here you went out in a car in awful, thick, snowy weather, got too close and crashed.
Chalk it up to experience and hope that insurers are taking whiplash claims with a pinch of salt at the moment. Which coincidently is what the road was lacking.
