My girlfriend has 6 brucie bonus points for two minor incursions. Do they cease to be valid on the third anniversary of the date of the offence or the date of conviction? (one incident went to court so there are two dates on her license for one offence).

Thanks.

I won't tell her she's got another 3 months before the first 3 points come off then, unless she asks. She's still collecting handgrenades to camouflage as cup cakes for the Surrey CPS Christmas ball

It's 3 years from the date of offence, rather than the date of being found guilty

Has it changed? It definitely used to be from the date of conviction.

Definately 3 years from offence not conviction before they cease to count legally i.e. totting up
4 years before you can get them taken off the license.
Usually 5 years against your insurance.

Interesting, I thought it was from offence, if FPN, but from conviction if court appearance.

But if it's right then I've got less than 1 year to go (from date of offence) until a 'clean' licence (if I don't 'earn' any more ) if not then a bit longer as my heinous crime took 9 months to get to court.

Hey guys lets have no more conflict....

An endorsement for speeding remains on a Licence for 4 years from DATE OF OFFENCE. (commital).(3 years for totting procedure)

Don't believe me. Go to DVLA site, Drivers, Endorsements

Interesting so if, as in my case, the case takes a while to get to court and during which time existing points expire (my existing 3 pts expired the day after I got nicked ) then would they still be counted for a totting-up ban (they were valid at time of offence) eg - I was given 6pts, but 9 months after the offence & expiry of previous 3 pts - If the previous pts had been 6 not 3 would I have been banned under totting up even though they were expired at time of court appearance?

Caz

AIUI Totting is from the date of offence, otherwise one could delay Court proceedings to allow points to disappear from Licence and escape a ban.

If you were on 9 points and were reported for offence likely to attract another 3 which would take you up to the 12 and a possible ban, but the day after being reported 3 disappeared from Licence under the 3 year rule, then at Court they would still tot as 12 i.e. from date of offences and not from the Court dates.

From the court point of view I think this is known as 'having your cake and eating it'

Cheers DVD, thinking back to the court appearance, in summing up the Mag said (after giving me 6 pts) that as I was now on 9 pts that I had better be very careful. I did think it odd as technically I had a 'clean' licence until that day but I suppose they work on the state of licence as per offence date - and as I had just escaped a ban I didn't want to rock the boat....so I kept me mouth shut .

BTW wouldn't it be a bugger to be 'totted up' for the sake of a day
