I bought a car last June and from day one I had problems. Just small things like a duff thermostat and a rattle on the door trim. I also had a noice which seemed to be coming from the clutch when I changed gear.

Now the car went back and forth to the dealer to get these problems sorted and various problems were diagnosed with a cost - I had warranty and suddenly the problems were no longer there according to the dealer.

Anyway the main problem is this. Eventually they got me to take an engineer out in the car to listen to the clutch noise and he concluded that it was infact the diff - Weird I know.

So my car was booked in for the work and it seemed best they had it whilst I was on holiday. They collected the car and returned it, with a new diff but also a new clutch (I found this out after).

I took the car for a drive and the noise was still there, so I called the dealer and told them I was going to take it elsewhere. They suggested I owed them for the clutch and I said I'd call back. I called the Dealer Priciple who had arranged for the work and he said he'd sort it.

So I took the car else where and the dealer said it was a normal noise something to do with dual mass flywheel!!!!!

Anyway I exected it and after a while I got used to it. Then recently I have started to get a banging noise from the rear of the car when I change gear. I took it to a local (known to me) Independant and he said it was the diff - Wierd I had one in August.

I've had the car in at the dealers today (not the original dealer) for a service and they have called to ask if I want them to complete the service as the noise is very serious and it appears the diff has been ripped of the car.

They have said it's not a warranty issue and it is actually damaged. I mentioned the new diff and they said I'd have to take it up with the original dealer.

Now where do I stand with this? The car is a 2000 W 328ci with BMW warranty. There has been problems from the start and now a major problem. Will I have to pay? What action should I take?

Oh yeah, I still have copies of all the original letters from the initial porblems.

Any help would be great.

Your best bet is to have words with your Trading Standards who will advise you of your rights under the Sale of Goods and Services Act. The longer you accept matters the worse ir becomes in relation to any claim.

Indeed. You have 6 years (or something) to diagnose a fault that was there when you bought it.

TSO (as above) or Citizens advice should help you out.
