Employers can force retirement, court ruling suggests

"A landmark ruling by the UK Supreme Court has outlined the powers that employers have to force workers to retire.

The court unanimously dismissed an appeal by a solicitor who was told to retire by a City law firm just after his 65th birthday."

Fortunately, although old enough to be affected by this in the not-too-distant future, my employer has made it clear that he has no intention of ever retiring me.

Problem is there are certain jobs which become very difficult to do the older you get BUT people can no longer afford to retire. However due to legislation the only way to get rid of such people is to terminate on grounds of incapability which is not ideal for either party.

Especially if they are, in fact, not incapable.

I do not think the cited court case does give any employer carte blanche to demand termination of employment on or after retirement age. From what's been reported there are special features in the case. However, from it what may emerge are a set of features which, if in place, any employer could follow to terminate a contract.
