Bought an electrical item on eBay using Buy it Now, paid at once via PayPal and item was delivered yesterday, so badly packed it is covered in dents, scratches etc. (the volume knob is so badly pushed in I dare not plug it in to see it it works). Cost was approx £125 inc shipping. The packing is so woeful that if a claim is made on the Post Office I feel sure it will be denied once (if) they inspect.

Within 5 mins of delivery, sent a nice polite e-mail to the seller advising damage and asking if I could return. No response so started a case in eBay's resolution centre. This at least got a response whereby the seller says it was perfectly packed, he has never had a problem before and I must have broken it (in multiple places within a few mins of it arriving!)

I've never had experience of anything like this before, what do I do? Send it back in the same terrible packaging? Hang on to it and escalate the case (I believe I can do this after 8 days?) Even if I do, whilst I have photos of the packaging and a broken item, the seller has my money - any advice, or is this going to be a hard lesson learnt?

Any advice very gratefully received.

If it was so badly packaged why did you sign for it?

Because until I opened the box and saw that there was nothing to support the item in it I didn't know - the box was knocked about, but provided the item is well wrapped this should not be a problem, when a nice receiver is just placed in the box the inevitable happens.

If like me, and you have stuff delivered to work, then anyone can sign for it and it will not be checked.

OP - are you covered by the 7 days distance selling laws?
I'm not sure it they apply to ebay???

Not something I'd recommend but have heard of people doing it - send some extremely well wrapped up bricks back to him, he can't be bothered checking it on delivery and signs for it.
You then dispute his claims of not sending it back and say he's trying it on!
Do remember, though, he has your address...!

Because you've opened a dispute, the money is taken back from their account. If it's not resolved, you'll get your money back.

It's hardly eBay's fault is it? It's the seller's fault.

I've been using eBay for buying and selling since 2000, and never had an issue.

Thanks, not interested in revenge! Just being honest and getting my money back - I'm happy to send it back at my cost, what has upset me is the seller knows it was crap packaging and is blatantly lying to eBay in his responses, why can't people just MTFU and admit they didn't do a proper job, for the sake of £1 of bubble wrap it would have all been okay, I just don't understand the mentality.

See, thats your first mistake - bestowing your own virtues onto other people.
Ebay is littered with, for want of a better word, bds!
frown

I only sell sporadically on ebay but really go to town on bubblewrap and cardboard - it's just not worth the hassle of somethings being battered about.
There's something in having 100% positive feedback over a period of 10 years and 400 transactions that I quite proud of. smile
Last week I even refunded a few quid to someone from the US as my actual postage cost was less than I'd charged her.
I know, I know, I'm a saint...!
