Being an outsider looking in, what is the legal justification to having the registered owner receive a camera-generated citation, and not the ACTUAL driver? Has the UK legal sistem gone all Frenchy, and you are "presumed gulity until proven innocent"?

Here, If my kid is driving like the moron that he can be, HE will get a ticket, not me.

But of course his mother will get all weepy and say " he's having a tough time, let's just pay it this time".

My point, exactly. How is it _legal_ to reqiure me to prove MYSELF innocent and not YOU to prove me guilty? The only thing "proven" is that a vehicle registered to me has possibly broken the law.
Doesn't seem quite right.

What about fair play?
What about legal rights?

(Reviews 50 years of UK and US legal history)

Er, never mind.....

Where are the "legal beagles" or "tort terriers" when you need a question answered?

Sorry, just looked at the clock! I'm having lunch, and you Street are prolly having a late snack.

Best,
Dave

Just Dave, what happens here in the US when your car is parked wrong? You, the owner, get a ticket against the car. Not the fellow that parked it, the fellow that owns it.

Now, here in Houston I know that if you go to court and swear that it wasn't you, AND you turn over the name of the fellow that parked it, then you can get off.

It's exactly the same way with speed cameras in England.

I'm sure I read a little while ago that the whole "Innocent until proven guitly" thing was offically gotten rid of from the British constitution sometime last year. Anyone know better?

I hope so

I know what you are saying, I was speaking (possibly not clearly) to the impact that a moving violation would have on my insurance. I do get many Parking Meter fines every year, and none of them have ever affected my insurance. They could, if they were not paid and then leading to warrants.....

Still not the same, as the Meter Dude or Dudette has to actually come by and physically cite my car for the expired meter. Nothing like the personal touch, eh?

You could just nominate a foreigh dude and let the cps sort it out. You don't have to say anything else. How about naming a nice russian chap. I'd like to see cps writing to him in his mother tongue Make sure you have the piccy's first.

Note that in France they can not oblige you to say who was driving if it is not the owner in the photgraph. All they can do is give you an administrative fine and no points.

That begs the question why some of the radars that they've installed take a photo of the back of the car - the only response is that the frogs are not aware that they have to be clearly identified in the photo. They've been so frightened by the media coverage over th alst couple of years that they crumble...

Guess what happens when you're cheeky to the French police? Oh yes.....very brutal in their arrest techniques.....the whingers and whiners in this country would faint if the British police employed such French tactics...
