RTA not my fault but mot had run out aaaahhh!!

Hi boys,
I need some advice. I was involved in an RTA not so long ago. A lorry wrote off my ickle car, clearly his fault, but.... when I got home and started sorting out my documents I realised my mot was out of date(1 month 20 days)not on purpose. I had already started legal proceedings against him and now his insurance comp are asking for my V5 (no probs) and my MOT.
I am expecting that I won't get any money for the car now, but d'ya reckon i'll still be able to claim for the whiplash?
I am really worried I am going to get into trouble for my mot and end up paying loads in legal costs.

As far as I am aware you don't need to show *them* your MOT, as they have no right to ask for it.
He was liable for the accident = he pays. If they dispute then you go to court. Whether or not you have an obligation to provide it then, I have no idea but considering it's all civil stuff I doubt it.

Well my solicitor said the third party insururers are asking for it. While they investigate the claim I don't really want to turn round and say 'you've no right to ask for it' coz they will know something's up

But if you are feeling bad 'bout yr halo slipping you'll be glad to know that I got my com' uppance when a couple o' weeks after the accident when I was car-less and practically headless I got a speeding fine and 3 points for the day before the accident. It never rains but it poors
