Last November, MrsC was involved in an RTC where a bike cut across from the inside of a roundabout to the outside, across the front of her, misjudged it, and hit the OSF corner of her car. BiB attended, the biker was stick on at the scene and subsequently offered a driver awareness course in lieu of prosecution. We have written details from the police confirming this course of action was carried out, and we have independent witnesses that the biker was 100% at fault.

Our insurance company have fannied about for the past 7 months in terms of resolving the claim with the third party, with the result that it's still outstanding although the car has been repaired. It's now close to renewal date and since the insurance co haven't resolved it, they have knocked MrsC's NCD back (was 3 years, as she's only had her own insurance for the past 3 years, now allegedly 1 year) and she has't yet had her excess refunded.

The question is; how can we get a favourable renewal quote (from elsewhere) when her NCD is being cut when it shouldn't be, and we can't categorically declare a non-fault claim, solely and simply because we have had to keep chasing the insurance company every few weeks to get their finger out and close this off - which they have so far not been ar5ed to do. The current insurers have even agreed, albeit verbally, that it's a full 3rd party claim, but they simply haven't completed the negotiation and admin to close this off.

To get the insurance sorted by tomorrow for e.g - you will have to declare the claim as fault as it is techinically still open as I am assuming your insurance has not recouped all of the repair damage and excess from the third party insurance- therefore it is not closed.

When you set up the policy you will have to pay the more expensive premium- but when the claim is closed as NF and the NCB is put back up- then your insurer should be able to back date to what you 'should' have paid at the beginning of the policy, and give you a refund...possibly with an admin fee taken off. (Check that with whoever you renew with though)


I personally would be hassling your insurance to get a result- or if you have legal protection on your policy speak to them and get them to write a stern letter to the TP insurer to hurry up and pay out as liability has already been agreed! I was once in a similar siutation as you and a few stern letters from the solicitor soon made them pay up smile

OK, thanks - we have already advised them that we will take it to the ombudsman (or whatever that service is called these days) but I'll check ref legal protection and see if we can go down that route.

Hmm - a little pressure on our outgoing insurers, and a quick call from them to the 3rd party insurers, and all resolved in our favour. Which was nice. NCD returned to previous levels, non-fault claim registered, and just have to wait for the excess to be refunded now.
