15% ... non-compliant sites

On the back of the NIP I received yesterday it states;

"The rules governing netting off do allow up to 15% of speed enforcement to be undertaken from non-compliant sites"

Is a Scamera van parked in a lay-by with no warning signs in the preceeding 5km monitoring from such a non-compliant site?

Has anyone challenged anything like this?

they are guidelines not rules, hence the scameras will routinely ignore them
