Not sure if this is for Finance or Law...but...

My pregnant girlfriend is still married to her ex husband. We are looking at buying a house together, but wondered about the implications of still being married to him. Would he have any rights to our house for any reason? What about the child? (I assume not for the child, but you never know)

No, No, NO NOOOOOOO.

If they divorce, your house will be classed as 50% hers.

Get it sorted (divorced) first.

I sought legal advice on this and its a minefield.

Then wait or part of your house could end up in the divorce... Or buy it yourself and don't put her name on any of the paperwork.

Ah yes. Hopefully it will turn up tomorrow, so I can actually see what I have purchased!

Warning bells ringing! Sounds like you should rent until the divorce is finalised.

Or OP can buy only in his own name if he can afford the repayments on his own.

Could your OH sign as guarantor but have no claim on the propery? Just a thought.

I dont wish to highjack the thread but my pal is in a similar situation however further down the line than you,

He is 30, and his girlfriend is 28 who have a house together (with mortgage between them) and she is still married to a guy and between them have a 6 YO daughter, who lives in said house with mother and my pal. My pal and his girlfriend also have a 2YO daughter together.

Now i know in the eyes of the lord he is going to hell for having a child with a married women etc, but for some reason she will not budge on getting a divorce, he has badgered and badgered her to get it sorted but she keeps saying, i have 1 thing left to do etc, He wanted her to get this divorce sorted before there daughter arrived (and that was 2 years ago!!!)

We think shes up to something, i.e. alterior motif but she wont spill the beans etc, i think he's said when buying the house that he's covered if they split etc, but not if he dies??, who knows.... Shes Polish buy hey ho. Basically is he fked? if things go pear shaped?

Tenants in common or joint tenants?

Answer this, and all becomes clear - all is conjecture at this point...

A guarantor has to be able to cover the entire mortgage, not just the 15k shortfall.
