Hi
I am currently on holiday and bought a bike I got offered over gumtree, Done it many a time before. It was getting dropped of at my mam's yesterday, Which it did.
The bike was meant to be a 2012 and i asked the lad twice if it was 100% a 2012 and he confirmed it i also sent a pic of a 2012 bike to him and he also said yeah its the same.
Got the pics last night of my mam to find out it is a 2006 bike, I told her when the lad drops it off get his reg so i have that. If i report it to the police/fraud line do I have a chance of getting the £800 back? I am in talks with the guy now and i said give me half back as that is the value of the bike but he's just coming up with a load of excuses.
Cheers

Good luck with that, can't see any way back of getting your money unless he coughs up frown

Test his character by threatening with legal action. He may buckle & cough up.

I did threaten him with legal action, Saying i am going to pass his details on to the police and he did st him self and was texting me saying we will sort this out and that they are sorry. They even asked for my mam's number (As im on holiday) to sort it out.
Then they started going quiet saying his daughter is in hospital and he's busy, wont hold my breath.!

Sounds like he will buckle then. Perhaps he is telling the truth & perhaps he does intend giving you some money back.

The Police will not help you one little bit, although technically it is fraud by misrepresentation. If the seller does not refund your payment or reach an agreement with you then you will have to obtain a CCJ and enforce collection of the same if required.

Feel free to PM me if you have any questions regarding this.

Thanks for the help. I will probably be in touch in a couple of days if nothing happens.

Just tell him unless he provides the correct bike or 100% refund within 48 hours, you'll initiate a small claim which could result in a CCJ. I recently did this with an eBay sale ... bought a bike and picked it up (no pedals) and got it home to find the crank arms threads were knackered so unable to fit any pedals. Seller reluctantly agreed to pay £30 towards new chainset or repair but the money wasn't sent.

3 weeks later he changed his tune and said he wouldn't provide a refund. After a few messages I just went online and completed the small claims application which costs £25 .... within a week I had an email pleading me to retract the claim ... which I did on the basis that he paid the £30 plus £25 small claim application. Money arrived literally within minutes to my PP account.

Go for it!
