i am employed as a warehouse operator but i hold a class 2 driving liscence,my employer has told me that i will have to do some driving against my wishes.can he legally do this and or is he in the wrong if so what are my options.i would be thankful for any advise

I believe forcing someone to work against their wishes is called slavery and they made that illegal a long time ago.

Tell 'em to bks (unless the money's good)....

What does your contract of employment say? If it has a clause which requires you to perform such duties then you probably either need to do it or resign before you're fired.

They can ask you to do it but you don't have to unless it states it in your contract.

After 09/09/2014 you might have the upper hand if you do not do the 35 hours of driver cpc because without the dcpc you will not be legal to drive LGVs commercially

How long have you been there? Is there a risk of being made redundant in your current role.

Why not offer to do it, as a very short term measure whilst they find someone else to do the driving role, if your current position is safe.

If they are stuck temporarily then I'd help out personally.

That way, you're being as helpful as you can without simply refusing.

You never know you might find you like having a bit of time out in the lorry rather than sitting inside a warehouse all day.

As its not your usual role tell them you don't feel confident enough to do it and ask they put you through a refresher course first. If they say no then surely you can say no as well smile

What is your reason for not wanting to drive?

If you simply "dont want to"

Then I suspect you will probably find yourself out of a Job one way or another.

If you have a genuine reason, like a medical condition then you might have a case for refusing.

Either way your options are pretty simple.

Don't do it and start looking for a new job (jump before your psuhed)
Or
Do it. As said you might find you like a bit of verity from your normal role.

Just tell them your nervous, you haven't driven for a long time, and you'll likely crash.

Tell them you haven't driven since 'The incident' then stare into space.

That'll spook 'em.

Its a tricky one...

Dont forget in the current economic climate can you pick and choose?

Theres 2.5 million on the dole....and thousands who would drive no sweat!!!
