SMP maternity pay

Question
Employer has sent a letter saying if you decide not to return to work you must pay back £x - the entire pay from leaving work to date. However the issue is the Statutary Mat pay is £135 per week for 33 weeks and provided you were employed there after week 25 of the pregnancy and were employed there for 26 weeks then you qualify
My wife had 8 years continuous
And left on week 33 ish
So fine meets both
Now direct gov is very clear but the letter from the employer is also very clear on what is due.
Am I missing something here?
Direct gov states if you choose not to return to work you get to keep the SMP.
Wolfe is a teacher so has accrued in theory 28 days holiday if she was returning shed get nothing but in the burgandy book it states holiday pay can be made in certain circumstances for leavers - what is this?
For my wfe this holiday pay could total nearly £4k so a significant amount to not give away.

My wifes school reserve the right to request the money back if you do not come back, we were thinking about putting the difference in an account and seeing what happened. In the end she went back.
She is off again under very different circumstances which also constitue maternity leave, and will now (probably) go back after the 50% pay drops of. She would at the moment have to give 1 months notice within Maternity Leave of not coming back or returning. Once she returned she would have to give the normal half a term notice. Depending upon the due date is it worth coming back and working a short half term?
We made the decision that it's an investment in our child having mum at home (provided its affordable).
Both my wife and myself had stay at home mums so feel not doing the same is quite an injustice to the littleun.
The other thing as my wfe is primary school teacher she sees a marked difference between those kids who have been fortunate enough to have stay at home mums while those who had to have baby sitters etc are some way behind.
Now I didn't buy that ... However 2 separate friends of ours had kids at the same time one kept mum at home the other back to work ASAP. They are two now.
The one who had stay at home mum can identify a Baracuda (and say it amongst animals I have to say I've not heard of) the other can grunt a no... One you can have a chat to the other zero.
Once I saw that my mind was made up - both parents are masters qualified and similar financial situation up to the birth.
Both my wife and myself had stay at home mums so feel not doing the same is quite an injustice to the littleun.

Now I didn't buy that ... However 2 separate friends of ours had kids at the same time one kept mum at home the other back to work ASAP. They are two now.
The one who had stay at home mum can identify a Baracuda (and say it amongst animals I have to say I've not heard of) the other can grunt a no... One you can have a chat to the other zero.
Once I saw that my mind was made up - both parents are masters qualified and similar financial situation up to the birth.
Currently deciding on a similar situation for our second; to leave or go back. my wife is a Uni lecturer and went back 9months after our first (at the end of the uni maternity contribution). Her rule set is that the uni will request back the maternity pay if you don't come back to work for a 6-month period following maternity leave.
Your last statement is somewhat sweeping, but I accept the sentiment. Our first is currently two and a half and can hold a 'serious' conversation. The word anemometer has come up, and she's asked about con-trails from high flying aircraft. She'll try you out with one line of conversation and if that doesn't work she'll come at you from a different direction to try and illicit an answer to her first question by different means. Short answer, we're struggling to keep up!!
For background: both parents educated to PhD level, both at full time work, little-un in nursery 5-days a week and grandparents too far away for regular visits. However, we make sure that between home time and bed time we educate as much as possible.

If we are talking development then Joseph is just 2 years and 1 month. Wife works 3 days a week, Joseph spends those days at a child minder who only has 3 under 2's or what ever. He can talk pretty well, and my wifes sister who didn't work said that he talking is better than her eldest who didn't talk to 2 and half. She is now super bright and they are talking about taking her out of normal school.
Another of Josephs friends parents are virtually both full time and he has been looked after by grandparents, he knows all his shapes up to a 12 sided on, all the colours (about 20 shades), and says things like red light on the traffic lights car needs to stop, he also knows seperate types of animals within a species. Then again he cannot build a Thomas the Tank engine timber railway tracks, make the magnets connet.
Joseph can also do 3+ puzzels on his own when he feels like it.
I think a major thing that influences there development is how much children are talked to and the variety of conversation. I expect that talking about planes and con-trails is due to a plane mad dad or relative!

Sounds very familiar. And I'd agree about influence based on how they are talked to; we never talked down to her.
The contrails question was posed to her mum, and not me. She was just walking round at the back of the house and saw the trails, asked her mum who promptly was struck dumb.

She received the basic SMP - oddly I assumed 6 months full pay but there you go. So 90% for 6 weeks then £135 per week.
God it's an odd feeling wife resigning work for at least four years... Investment is worth it though.
