buyer calls to pick up over 2 years later...

Hillarious, just had someone call to ask if they can pick up the engine they bought from my father.
That was over 2 years ago, it was arranged to be picked up by palletline, so I put it on a pallet ans trapped it up for them... no one ever arrived and never heard from them again, until this morning..
pretty sure the engine would have went for scrap as it was left on the farm it was stored at when no one picked it up, it would be due rent for storage too if its still there lol...

if it was paid for it belongs to the buyer..if not after 2 years id imagine their having a laugh expecting you to have it still!!!

as far as i am aware it was paid for, just checked and it was much nearer 3 years ago.
He certainly isnt getting a refund.

just called the lad with the farm and its not there anymore..

If you can find the engine, let him know that he can collect it when hes ready, but after he has paid backdated storage fees for it!

difficult one if he wants a refund...legally its the buyers propery did you make an effort to make contact after the sale?

Never heard a thing from him in well over 2 years, he knew we were clearing a storage area and it needed to be shifted. He can whistle for his money as after 2 years i would say its completely unreasonable to expect my father to keep paying storage for it. We are not talking a big money item here, from memory I think he paid £80 ish..

Breach of contract limitation period is 6 years, although I have no idea whether that applies to a simple sale; I assume no signature, receipt etc. were involved?

nope, no reciept or any paperwork at all, he sent a cheque with a scap of paper saying he would be in touch to arrange pick up the following week.... then we heard nothing more.

Hopefully this won't go to small claims court. If it does then hopefully they will take the common sense approach and side with you.

the farm does charge storage fees, so he would be responsible for them which over more than 2 years would equate to more than the ammount paid anyway.
