Job Agency Question

Evening all,

Until Friday I was working for a national office/admin based agency, well here's the story...

I was assigned to work for an organisation for 1-2 weeks in March of this year, The organisation decided to keep me on with them moving me to different departments etc, I really enjoyed it, the working environment was great along with the people.

Earlier this week I was told my 'assignment' had come to an end.

I called the agency to see if there was any other work avalible, they had a role starting on the Wednesday just passed, I accepted the 'assignment'

On the first day I attended the assignment. I was told 'Just get on with this filing' when I say filing, it was four members of staffs filing from the previous month! A mound of it.

I got so fed up/mindnumbed of just filing I walked out whilst on my lunch break (I know this was the totally wrong thing to do) I didn't tell anybody I was going I just went.

Sorry... Here's my question, from my first assignment I had accrued 11 days holiday pay. Am I still entitled to this?

I'm not to bothered about the 2 1/2 days wages

You are entitled to what you have worked. Whether they will employ you again is another matter. Why on earth could you not have simply called the agency, told them the placement wasn't suitable and managed to "cope" for the rest of the day?

You obviously haven't been unemployed for long enough to realise the value of having work, agency or not.

But yes, legally you are entitled to be paid for actual time worked.

Thanks Burriana, I know now exactly what I should have done, yes i've not been out of work since 14 i'm now 20

You are entitled to your unpaid holidays, provided you take them in the holiday year you accrued them!

You may find that the agency use the default Oct to Sept period as set out in the Working Time Directive which as you may notice has just ended. If they can demonstrate by way of contract that you didn't take your holidays you may well have lost them (which is the case with most employers and not restricted to employment agencies).

My advice is check any correspondence you will have received from said agency and look for the heading 'Statutory Leave.' There you will most likely find the defined holiday year. Once you are happy you are still in the relevant year simply ask the agency for your holidays to be paid.
