So I’m looking for a 05 or 06 S4 and I came across a 05 on ebay for great money.

I speak to the seller and he says all the right things, I get a Data check done on the car which comes back all clear bar it’s had a few owners (but he told me that).
It has some 3rd party wheels which are not for me so I’m having it with the stock 18’s, the seller says they in need of a refurb but if I put down a deposit he will get that done and a new MOT.
Deposit is sent (a couple of hundred quid) and all is good.

Today a car trader friend of my dad’s mentioned that for the S4’s and RS4’s it’s a good idea to get a VAGCOM plugged in to see any error codes. I phone the seller and tell him I’d like to do this before picking up the car and doing the full deal, I’ll pick up the cost he just need to take it to the nearest Audi dealer.
He is not too sure when he will be able to do it (very busy etc) and we leave it that we will arrange it after he has a new MOT on the car.

Next thing I know less than an hour later he he calls me to tell me he has relisted the car as he does not want to ‘fk about’ and has people queuing up to give him money… And now I don’t know where I stand..?

Am I being unreasonable about the Audi check? Is the fact I asked for it after putting down a deposit completely out of order??

Usually the "deal is done" before a deposit is paid and it's a bit unusual to go back afterwards with more requests.

One of two things.

He really does have other parties ready to pay and take the car away.

He has something to hide.

I think by the sounds of he has helped you out with the wheels and thinks you are now messing about and can't be bothered.

I think having paid a deposit on one basis then changing it probably makes the deal invalid.

He should give your deposit back and you should buy a different car.

To clarify the wheels refurb.

The car needs a single new tyre to pass the MOT he said he would of course do that. He has a super cheap contact to refrub wheels.
So I asked if I covered the tyre would he sort the refurb (same cost).
